1. Acceptance of Terms

By accessing, browsing, registering, sending forms, uploading content, requesting reports, or using any functionality of Goetia.ai (the "Platform"), you agree to be bound by these Terms and Conditions, as well as by the applicable Privacy Notice.

If you do not agree wholly or partially with these Terms and Conditions, you must refrain from using the Platform.

2. Nature of the Platform

Goetia.ai is a technological platform that uses artificial intelligence, automated processing, algorithmic models, computational rules, symbolic analysis, and inference engines to generate categorized content, interpretations, reports, predictions, analysis, and personalized responses based on the information provided by the user.

The Platform is not a human being, does not reason like a certified professional, does not possess independent human judgment, and can make mistakes.

By using the Platform, you expressly acknowledge and agree that:

The results are generated wholly or partially by automated artificial intelligence systems.
The Platform may produce incorrect, inaccurate, incomplete, outdated, ambiguous, inconsistent, biased, artificial, imprecise, or inapplicable responses to your specific case.
The Platform may misinterpret data, images, context, language, emotions, dates, names, family relationships, personal narratives, or symbols.
The results may vary between one query and another, even with similar or identical information.
The Platform does not guarantee absolute logical continuity, perfect coherence, or uniformity among responses.
The Platform does not offer absolute certainties, revealed truths, infallible statements, or deterministic results.

3. Non-determinism and absence of accuracy guarantee

Goetia.ai is not a deterministic system. Its outputs may depend on multiple technical, contextual, probabilistic, redacting variables, input quality, system configuration, semantic interpretation, and automated processing.

Consequently:

We do not guarantee that a result is true, accurate, verifiable, complete, or scientifically validated.
We do not guarantee that an interpretation is correct or applicable to your personal situation.
We do not guarantee that a prediction will occur, be fulfilled, or reflect a future real event.
We do not guarantee that the generated content is free of logical, technical, contextual, or redaction errors.
We do not guarantee compatibility between the Platform and your subjective expectations, personal beliefs, or future decisions.

All content is provided on an "as is" and "as available" basis, within the maximum extent permitted by applicable law.

4. Informational, recreational, and non-professional support purpose

The Platform offers informational, interpretive, recreational, reflective, cultural, experimental, symbolic, spiritual, entertainment, or general support content to the user, depending on the nature of each service.

The Platform does not replace the intervention of duly qualified human professionals when an issue requires medical, psychological, psychiatric, therapeutic, legal, fiscal, accounting, financial, patrimonial, investment, insurance, educational, or any other regulated professional attention.

5. Express exclusion of professional advice

c) It is not financial or investment advice

The Platform does not issue investment recommendations nor does it constitute financial intermediation, professional stock market analysis, public offering, invitation to invest, patrimonial advice, financial planning, recommendation to buy or sell assets, nor advice to operate financial instruments, cryptocurrencies, currencies, stocks, derivatives, funds, bets, or assets of any kind.

All content related to money, abundance, probabilities, cycles, scenarios, or trends must be understood as general, speculative, reference, or recreational material, never as an instruction to invest or take a financial risk.

d) It is not a betting recommendation nor a guarantee in sports predictions

The soccer, NFL, boxing, or other sporting event prediction services do not constitute a betting advice, professional tip, guarantee of success, wagering recommendation, nor an invitation to participate in games of chance.

No sports prediction is safe, deterministic, or guaranteed. Every sporting event is subject to unforeseen factors, randomness, human performance, refereeing, weather, injuries, tactical changes, and other variables beyond the Platform's control.

If the user decides to bet, risk money, or make economic decisions based on any output from the Platform, they do so under their exclusive responsibility.

6. Symbolic, interpretative, or phenomenological services

The services offered by Goetia.ai, including by way of example but not limitation tarot, Spanish deck, birth chart, horoscope, numerology, palmistry, dream interpretation, oracle, grimoire, family constellations, and sports predictions, are presented as symbolic, narrative, interpretative, computational, or phenomenological analysis experiences.

These services must not be understood as infallible truth mechanisms, guaranteed divination, future determination, conclusive scientific proof, nor as a substitute for specialized human processes.

7. Age of majority and legal capacity

By using the Platform, you represent and warrant that:

You are of legal age according to the legislation applicable to you.
You have sufficient legal capacity to make binding contracts.
You will not use the Platform on behalf of a minor without valid legal authorization, when applicable.

Notwithstanding the foregoing, certain services may be exclusively reserved for individuals over 18 years of age. Nube Ninja, S.A. de C.V. may suspend, cancel, or block access when reasonable evidence of use by minors in contravention of these Terms is detected.

8. Representations and responsibilities of the user

The user represents, acknowledges, and agrees that:

The information you provide will be truthful, complete, and updated to the best of your knowledge.
You understand that the quality of the result largely depends on the quality, accuracy, and sufficiency of the information provided.
You will not use the Platform for unlawful, fraudulent, abusive, misleading purposes, or purposes that violate third-party rights.
You will not upload content that you have no right to share.
You will not use the Platform to make critical decisions without independent human validation.
You assume full responsibility for the use you make of the generated results.

9. Third-party information

By providing data, narratives, references, or images related to third parties, you declare that you have sufficient legitimacy to do so or that you assume full responsibility arising from such information upload.

Nube Ninja, S.A. de C.V. shall not be responsible for third-party claims arising from information that the user has uploaded, described, or incorporated into the Platform without having authorization, legitimacy, or sufficient legal basis.

10. Photographs, images, and automated analysis

In services that allow the uploading of photographs or images, including photographs of hands, the user acknowledges and accepts that such images may be processed by automated systems to extract visible features, morphological patterns, and analysis variables related to the functionality of the requested service.

The Platform can make mistakes interpreting images. The quality of an image, its lighting, angle, resolution, shadows, focus, color, editing, or compression can substantially alter the result.

11. Use at the user's sole risk

The user agrees that any personal, emotional, patrimonial, professional, affective, sporting, commercial, financial, medical, therapeutic, or legal decision made based wholly or partially on the information generated by the Platform will be made at their own risk and sole responsibility.

Nube Ninja, S.A. de C.V. shall not be liable for losses, damages, costs, prejudices, injuries, frustrations, breakups, unfulfilled expectations, erroneous decisions, failed bets, failed investments, omissions, emotional consequences, or any other outcome derived from the user's use or interpretation of the generated content.

12. No warranties

To the maximum extent permitted by applicable law, the Platform is provided without warranties of any kind, whether express, implied, statutory, or of any other nature.

In particular, Nube Ninja, S.A. de C.V. does not warrant:

Accuracy, veracity, completeness, or reliability of results.
Fitness for a particular purpose.
Continuous, uninterrupted, or error-free availability.
Absence of vulnerabilities, failures, delays, or incompatibilities.
That the service will satisfy the subjective expectations of the user.
That the results will not be offensive, strange, artificial, contradictory, or unexpected.
That the generated content is suitable for high-impact decisions.

13. Limitation of liability

To the maximum extent permitted by law, Nube Ninja, S.A. de C.V., its shareholders, officers, affiliates, suppliers, developers, operators, licensors, and collaborators shall not be liable for direct, indirect, incidental, special, consequential, punitive, exemplary, or any nature damages derived from:

The use or inability to use the Platform.
Errors, omissions, biases, hallucinations, or incorrect interpretations of the AI.
Decisions made based on generated results.
Crashes, interruptions, delays, or breaches of systems outside reasonable control.
Improper use by the user or third parties.
Predictions, interpretations, or readings that do not match reality or the user's expectations.
Economic losses, loss of opportunity, failed bets, investment operations, reputational losses, or emotional impacts.

When applicable law does not allow totally excluding certain liabilities, any residual liability will be limited to the amount effectively paid by the user to Nube Ninja, S.A. de C.V. for the specific service that immediately originated the claim, during the 3 months immediately preceding the claimed event.

14. Use prohibitions

The user agrees not to use the Platform to:

Commit crimes or facilitate unlawful conduct.
Impersonate people, create fake profiles, or mislead third parties.
Obtain professional advice replaceable by human experts in critical contexts.
Generate discriminatory, violent, defamatory, fraudulent, or abusive content.
Attempt to decompile, breach, extract models, improperly access, or interfere with the Platform.
Use the Platform's outputs as if they were confirmed facts, definitive diagnoses, or binding professional recommendations.
Use the service as the sole basis for betting, trading, investment, health prescription, legal defense, or crisis care.

15. Intellectual property

The Platform, its code, design, structure, functionalities, interfaces, system texts, brands, logos, compilations, databases, flows, and distinctive elements are the property of Nube Ninja, S.A. de C.V. or their respective owners and are protected by applicable legislation.

Unless expressly stated otherwise, these Terms do not grant you intellectual property rights over the Platform.

Regarding the content you upload, you declare to have the necessary rights or permissions for its use. You retain your rights to your content, but you grant Nube Ninja, S.A. de C.V. a non-exclusive, limited, revocable license to the extent compatible with the operation of the service, to host, process, transform, analyze, and use said content in order to operate the Platform and provide the requested service.

16. Third-party services

The Platform may rely on services, infrastructure, or third-party components, including security, analytics, storage, processing, and validation tools, such as Google reCAPTCHA.

Nube Ninja, S.A. de C.V. does not fully control third-party services, therefore it does not guarantee their continuity, availability, accuracy, security, or uninterrupted operation.

17. Suspension, blocking, and cancellation

Nube Ninja, S.A. de C.V. may suspend, restrict, block, or cancel access to the Platform, temporarily or permanently, without liability, when:

There is a breach of these Terms.
Risks of fraud, abuse, improper automation, or unlawful use are detected.
It is necessary for security, maintenance, legal requirement, or protection of third parties.
There is evidence of use by minors in age-restricted services.
A use incompatible with the purpose of the Platform is noticed.

18. Availability of the service

The Platform may present interruptions, maintenance, updates, model changes, architecture adjustments, errors, performance degradations, loss of context, or functional modifications without prior notice.

Nube Ninja, S.A. de C.V. does not guarantee continuous availability or perpetual preservation of a specific version, specific model, response style, interpretation criteria, or a given functionality.

19. Changes in results, models, and functionalities

The user agrees that Nube Ninja, S.A. de C.V. may modify at any time the AI engines, providers, system prompts, processing rules, output criteria, design, functionalities, service scope, or operational structure of the Platform.

Consequently, future results may differ from those previously obtained, without this implying any breach.

20. Electronic contracting and validity

The user acknowledges that their acceptance by electronic means, the use of checkboxes, acceptance buttons, forms, data messages, digital records, authenticated access, and other technological interactions may produce valid legal effects according to the applicable legislation.

The electronic records generated by the Platform may be kept as evidence of acceptance, operations, consent, technical traceability, and use of the service.

21. Privacy and personal data

The processing of personal data is governed by the Privacy Notice of the Platform. The use of the Platform also implies reading and accepting the corresponding notice, to the extent legally applicable.

22. No fiduciary relationship or result guarantee

The use of the Platform does not create a fiduciary, medical, therapeutic, attorney-client, advisor-client, broker-client, analyst-investor, bettor-tipster relationship, or any other regulated professional relationship between the user and Nube Ninja, S.A. de C.V.

We do not promise results. We do not promise successes. We do not promise fulfilled predictions. We do not promise healing. We do not promise emotional, financial, athletic, legal, or patrimonial success.

23. Indemnification

The user agrees to hold harmless and indemnify Nube Ninja, S.A. de C.V., its affiliates, officers, employees, developers, providers, and representatives against any claim, demand, damage, prejudice, fine, cost, expense, or fee derived from:

Their breach of these Terms.
The improper use of the Platform.
The information or content they upload or share.
The impairment to third-party rights.
Decisions made based on results generated by the Platform.

24. Modifications to the Terms

Nube Ninja, S.A. de C.V. may modify these Terms and Conditions at any time. The updated version will be published on the Platform and will take effect from its publication, unless applicable law requires otherwise.

Continued use of the Platform after the publication of changes will constitute acceptance of the current version.

25. Applicable law and jurisdiction

In what is not prohibited by mandatory consumer protection, privacy, or electronic contracting norms that are applicable due to the user's domicile, these Terms shall be governed by the applicable laws of the United Mexican States.

For the interpretation, fulfillment, and resolution of controversies, the parties submit to the jurisdiction of the competent courts of Mexico City, giving up any other jurisdiction that might correspond to them by reason of their present or future domiciles, except for inalienable consumer rights or mandatory norms applicable in other jurisdictions.

26. Severability

If any provision of these Terms is deemed invalid, illegal, or inapplicable, the other provisions shall remain in full force and effect, to the maximum extent permitted by law.

27. Prevailing text

In the event that these Terms and Conditions are available in more than one language, the Spanish version will prevail for interpretation purposes, except for an obligatory legal provision to the contrary.
